Terms of Use

1. Acceptance of Terms

By accessing or using PawCare ("Platform," "we," "our," or "us"), including our website, mobile application, and services, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use our services. PawCare connects pet parents with veterinarians, NGOs, pet care providers, groomers, and shelters for vet appointments, adoptions, lost & found, pet care bookings, grooming, and related services. Additional terms may apply to specific features or services.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to create an account. By signing up, you represent and warrant that you meet these requirements and that all information you provide is accurate and complete. If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate, current, and complete information when registering and to update it as needed. We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or for any other reason at our discretion. You may delete your account at any time through account settings; certain data may be retained as described in our Privacy Policy.

4. Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You will not:

• Post false, misleading, or fraudulent information (e.g., fake lost pet reports, adoption listings, or reviews)
• Harass, abuse, threaten, or harm other users, vets, service providers, or animals
• Use the Platform for commercial spam, unauthorized advertising, or unsolicited communications
• Attempt to access other users' accounts, data, or systems without permission
• Circumvent, disable, or interfere with booking, payment, or security features
• Upload malicious code, viruses, or content that could harm the Platform or users
• Violate any applicable laws, regulations, or third-party rights
• Use automated means (bots, scrapers) to access the Platform without our written consent

We reserve the right to remove content, suspend accounts, and report illegal activity to authorities.

5. Bookings & Transactions

When you book a vet appointment, grooming session, or pet care service (walking, sitting, boarding, daycare), you enter into a direct agreement with the service provider. PawCare facilitates the connection and provides the platform but is not a party to that agreement. We are not responsible for the quality, safety, or legality of services provided by third parties. Cancellation and refund policies are set by individual providers; please review them before booking. Any disputes regarding services should be resolved directly with the provider; we may assist in good faith but have no obligation to do so.

6. Lost & Found

Lost and found reports must be truthful and accurate. False or misleading reports may result in account termination and may be reported to law enforcement. When you report a found pet, you agree to cooperate with the owner and PawCare to facilitate a safe reunion. We do not guarantee that lost pets will be found or that found pets will be reunited; we provide tools to improve the likelihood of reunion.

7. AI & Health Tools

Our AI Symptom Checker, Breed ID, and AI Assistant provide informational guidance only. They do not constitute veterinary advice and do not replace professional veterinary care. Always consult a licensed veterinarian for medical decisions, diagnoses, or treatment. We are not liable for any actions taken or decisions made based on AI-generated content. The AI tools are provided "as is" and we make no warranties regarding their accuracy or suitability for any purpose.

8. Intellectual Property

PawCare's name, logo, trademarks, and all content on the Platform (except user-generated content) are our property or our licensors'. You may not use them without our prior written permission. User-generated content (pet photos, reviews, posts) remains yours; by posting it, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute it in connection with the Platform. We may remove content that violates these Terms or our policies.

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL LIABILITY FOR THE ACTIONS OF USERS, SERVICE PROVIDERS, AND THIRD PARTIES.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAWCARE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED INDIAN RUPEES (₹100). Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability; in such cases, our liability will be limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless PawCare and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from (a) your use of the Platform, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) any content you post or transmit on the Platform.

12. Dispute Resolution & Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising from these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts in India. You agree to attempt to resolve disputes informally before initiating formal proceedings.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we may also notify you by email or in-app notification. Continued use of the Platform after changes constitutes acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Platform.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
